Terms of Service

These Terms of Service apply when you access kendalandgreen.co.uk or purchase products from Kendal & Green Planners. By placing an order, you agree to these terms. Nothing in these terms affects your statutory consumer rights.

  1. Products

We take reasonable care to describe and photograph our products accurately. Colours may appear slightly different depending on your screen settings, and minor variations may occur between handmade, printed or manufactured batches.

Product measurements are approximate unless stated otherwise.

  1. Orders

Your order is an offer to purchase products from us. An order is accepted when we send confirmation that it has been accepted or dispatched.

We reserve the right to decline or cancel an order where:

• a product is unavailable;
• pricing or product information contains an obvious error;
• payment cannot be authorised;
• we reasonably suspect fraud or misuse; or
• we cannot deliver to the address provided.

If payment has already been taken for an order we cannot fulfil, we will issue a refund.

  1. Prices and payment

Prices are shown in pounds sterling and include any applicable taxes unless stated otherwise.

Delivery charges will be displayed before you complete checkout. Payment must be made using one of the payment methods offered at checkout.

We may change prices at any time, but changes will not affect orders already accepted.

  1. Pre-orders

Customers may request cancellation of a pre-order before dispatch by contacting hello@kendalandgreen.co.uk. Where an order has not yet been dispatched, we will normally provide a full refund to the original payment method.

If a significant delay affects the estimated dispatch date, we will contact affected customers and explain their available options, including cancellation and a refund where applicable.

Products described as pre-orders are not immediately available for dispatch. The estimated dispatch period will be shown on the relevant product page.

Estimated dates may occasionally change due to manufacturing, shipping or circumstances outside our reasonable control. If a significant delay occurs, we will provide an update and explain the available options.

  1. Delivery

Available delivery methods, prices and estimated timescales will be shown at checkout or in our Shipping Policy.

Please ensure your delivery details are complete and accurate. We are not responsible for delays caused by incorrect or incomplete information supplied by the customer.

Risk in the products passes to you when they are delivered to you or to a person identified by you to receive them.

  1. Cancellations, returns and refunds

Your rights to cancel an online order and return products are explained in our Return and Refund Policy.

Nothing in these terms limits your rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 or other applicable consumer law.

  1. Faulty, damaged or incorrect products

Products must be as described, of satisfactory quality and fit for their intended purpose.

If your order arrives faulty, damaged or incorrect, contact hello@kendalandgreen.co.uk with your order number and, where appropriate, photographs of the issue. We will handle the matter in accordance with your statutory rights.

  1. Personalised products

Please check all information carefully before ordering a personalised or custom-made product. We are not responsible for errors submitted or approved by the customer.

The statutory right to cancel for a change of mind does not normally apply to goods made to the customer’s specifications or clearly personalised. This does not affect your rights if an item is faulty, damaged, misdescribed or incorrect.

  1. Website use

You must not use this website for unlawful or fraudulent purposes, interfere with its operation or attempt to gain unauthorised access to any part of it.

We may suspend or restrict access where reasonably necessary to protect the website, our customers or our business.

  1. Intellectual property

The Kendal & Green name, branding, photographs, planner layouts, written content and other original materials displayed on this website belong to us or are used with permission.

They may not be copied, reproduced, distributed, resold or used commercially without prior written permission.

  1. Third-party services

Our store is hosted by Shopify. We may also use third-party providers for payments, delivery and other services. Their own terms or privacy information may apply when you use those services.

Links to third-party websites are provided for convenience. We are not responsible for content or services operated by third parties.

  1. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

  1. Privacy

We handle personal information in accordance with our Privacy Policy.

  1. Changes to these terms

We may update these terms where necessary to reflect changes to our business, services or applicable law. The terms that apply to your purchase are those in force when your order is accepted.

These terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you will retain any mandatory protections provided by the laws and courts of the country in which you live.
